Hi All! In between consultation and retaining me for a NJ Divorce-client was served w/ an Oklahoma Protection from Abuse Order (TRO) & Petition for a Protective Order (FRO) from his Wife (she relocated there early September). PFO Order is returnable 11/5/19. All predicate and past alleged (denied) DV "acts" occurred in NJ, the parties resided in NJ for 11 months together, marital home is in NJ and Divorce to be filed in NJ. There is also a chance W may have early onset/signs of Alzheimer's. Client is a disabled vet w/ very little income/$ to pay fees. My Qs:
1. Anyone know how "open" Oklahoma is to pro-hac vitae/and/or provisional appearances? I did look it up and it seems provisional appearances are allowed under certain circumstances;
2. Would/Could a letter to the court, asking for adjournment, provisional appearance to argue lack of subject matter and personal jurisdiction and quoting the DV laws in Oklahoma be appropriate or construed as unauthorized practice?
3. IF Divorce is filed before the return date of the Oklahoma matter will the NJ court reach out to the OK court? or be open to the idea?
4. Anyone know a reasonably priced attorney (lol) in OK?
