  • 1.  "Intersex" Client Needs Atty Poss. Insur. Discrimination

    Client, whose mother took DES during pregnancy, is diagnosed "intersex" which means has the characteristics of indeterminate sex.  He is prescribed a certain gel that is basically testosterone...the insurance will not pay for it now (after having it raised in price higher and higher) so now he cannot get it at all.  He is on NJ PAD assistance...the state pays the premiums and MEDCO pays for the medications. The client seems knowledgeable and has called many people and says that some say it is the fault of ACA ("Omamacare") but others say the formulary has just "changed." No one will explain how the formulary changed or will send a copy.  Client thinks this is discrimination because of the sex-change thing (insurance companies won't pay for sex-change prescriptions) , except that here there is no "sex change" since biologically there is no specific sex and the need is to keep one sex, not change to a different sex.  I don't know whom to go for a referral for this client, who is in need of help.  Any ideas??
