  • 1.  International Alimony/Tax Question

    Posted 06-21-2018 07:00 PM
    Greetings Colleagues:
In search of someone familiar with international tax law, specifically as it relates to alimony to be paid by a US resident to someone in Australia.
Husband, US res, wants his alimony to be tax deductible.  Wife, Australian citizen returning to Australia, wants to know a) if her tax rate for her really is 30% (i.e. could she get any of that mandatory 30% withholding back), and b) if she must file an income tax return in the US, whether or not she is entitled to a refund of the withholding.  Additional questions include who could serve as the IRS withholding agent (must it be the Husband?).
    Thanks in advance!
    Heather
