  • 1.  Income Imputation ??

    Hello everyone,

    New client (Wife) works for a large local hospital in an admin position and is paid quite impressively.  Parties were married for 6 years and Husband got 3 years of alimony.  Husband worked for a local shipping company earning $30,000 per annum during the first two years of the marriage but after that he stopped due to Wife relocating to a different hospital. 

    While receiving spousal support for the past 3 years, Husband did not work since he lived with his parents and had spousal support coming in to rely on.  Now that support just ended, Husband just got a part-time job at Home Depot earning $10.00 per hour.  I want to have Husband imputed more than $400 per week since he has his associates from Brookdale and also has the opportunity to manage his parent's Italian restaurants full-time (they have three) and he has done this in the past when he needed money to make large purchases. 

    Working at Home Depot seems to make husband substantially underemployed and by keeping this position his child support and extracurricular activity costs minimal since both are based on percentage shares on the guidelines making it the case that Wife has the brunt of the expenses.   

    Suggestions would be greatly appreciated.  TIA
