  • 1.  Imputing income to a 70 year old Husband

Do you know of a reported case wherein the Court imputed income to a litigant at age 70?  This Husband worked until age 69 as a psychologist and then sold his practice just prior to seeking a divorce.  After the filing , we discovered a website in another state in which he relocated to advertising his psychology and consulting services and that of his daughter.  We have a vocational report finding that he can earn 100-120K per year.  This is a 16 year marriage and the wife stayed at home.  Any guidance would be appreciated.

"...Gifford filed a motion to terminate his alimony and medical insurance obligations. He contended that he was then seventy-three years old and 'would like to retire' but could not do so because of those obligations...."
