I am sharing important information received by the NJSBA about the process for filing tort and contract claims against the State of New Jersey, its departments , agencies, employees and officials, including State Colleges and Universities (Except Rutgers University). Please read the below information about a new digital claim portal starting July 11, 2024 that was sent to the NJSBA from Peter Ramos, Deputy Director, Division of Risk Management, State of New Jersey, Department of Treasury:
Effective July 11, 2024, all tort and contract claims against the State of New Jersey, its departments , agencies, employees and officials, including State Colleges and Universities (Except Rutgers University) must be filed using the digital claim portal on the state's Division of Risk Management website by accessing the Tort Claim Login Page (PACFS). This includes, but is not limited to, claims for bodily injury, property damage, automobile accidents, civil rights, false arrest, malicious prosecution, and foster parent liability claims.
The claimant portal allows attorneys and their staff to file and track the status and progress of all their claims. It also empowers them to amend the claim at any time after submission, and to upload documents when filing the claim, or at any time thereafter.
After the digital claim form is submitted, there is no need to 'file" or send a paper version of the claim to any other State Government Department or agency. This digital form is intended to serve and satisfy the Notice requirements of the New Jersey Tort Claims and Contractual Liability Act a/k/a Title 59, as to the Notice of Claim only.
Please refer to the Division's website, and to the Notice of Tort and Contract claim section for more information on the claim filing process: State of NJ - NJ Treasury - Division of Risk Management.
