  • 1.  Impact on immigration status by getting divorced

    Case facts: 

    Client got married to a U.S. citizen in August 2013 and filed for green card in August 2015. Thereafter, she filed for a waiver on 08/29/16. The waiver was approved March 2018 and a Permanent Resident Green Card was issued.

    The couple is now not getting along and she wants to file for divorce.

    Question: Other than having to wait 5 years rather than 3 to file to become a naturalized citizen, would there be any other adverse impact to her immigration status as a result of filing/getting divorced?

    IMHO only if there is an annulment.  divorce should not impact her permanent residency.
