Dear Section Members - I have a matrimonial client whose divorce complaint is ready to be filed. She and her spouse have been separated for 2 years. Client previously self-represented and filed for custody, visitation and wage-garnishment child support. She does not want any spousal support from him and is self-supporting.
Question 1. She and her family (parents, siblings) want to purchase a home together in which to live. Does the future-ex have any rights against the house pre or post divorce filing?
Question 2. How quickly in this process can a PSA be reached if husband is not contesting the divorce?
