    Does anyone know what the final version did with alimony treatment?  I looked at the news articles and tried to find it on line but could not, just wondering if anyone knew.

    Looks like it is beginning for Dec 31, 2018. It does not affect prior agreements.
    After Dec31, 2018, alimony will not be deductible for the payor and is not taxed as income to the recipient.

    What will happen to an agreement entered pre 2018 that gets modified via Order post 2018 when tax change goes in effect?   And is the IRS really going to be able to distinguish between taxpayers? (Those eligible for deduction versus those not eligible?)

    Per Gary Borger: looks like final bill was a compromise as to effective date. 

    "effective for any divorce or separation instrument executed after December 31, 2018, or for any divorce or separation instrument executed on or before December 31, 2018, and modified after that date, if the modification expressly provides that the amendments made by this section apply to such modification."

    Does the opt in apply only to the pre- 12/31/18 agreements or all divorce instruments

    At least it gives us a year to figure out appropriate non deductible alimony amounts.  I guess if people get audited then they will
    have to produce their judgements or agreements to prove the date.

    Oh, it will hurt a lot more than just the lower income people.  In alimony cases, tax treatment has a profound effect in life style on all but the very rich.  For most alimony cases, if Uncle Sam is not helping pay the alimony, as it were, both sides will be feeling the pinch under this new tax law.

    The point is that the alimony shifts some income to the less monied spouse, and since its "income" it should be taxable to the person who receives it. My assumption is that when we are talking about alimony post 2018 we will be looking at net income and not gross income.
