  • 1.  "for reasons set forth on the record and herein"

    Colleagues,

    Generally, when I file a motion, I end up with an Order with a statement of reasons attached.  Perhaps this is only provided when the Court rules "on the papers."  This particular motion was heard at 10:00am but the Judge advised she would issue the ruling on the record in the afternoon, at 2:30.  Neither my client nor I were able to be there at 2:30 so I picked up the Order this morning. There is no statement of reasons.  I called chambers and was told I have to order the transcript.  Lovely.  Is this standard operating procedure?

    To avoid the cost of a transcript you should be able to get a cd copy of the record for $10. It is also quicker, at least where I usually appear.

    Unfortunately, depending on the County and the Judge this is standard procedure.  It can be frustrating at times.  I agree though, you can request an audio cd of the reasons set forth on the record with the clerk for $10.  That is typically what I do when this happens. All you need to do is tell them the date, the Judge and the docket number.  Good luck.
