  • 1.  finality of post judgment orders

    Posted 05-16-2016 12:04 PM

I represent an out of state defendant (over 8 years with sole custody of only child under NJ Divorce decree). She is out of state after fleeing from DV occurring in 2008. DV final judgment entered. Father moved to enforce visitation and I cross moved for change of venue, denied without prejudice in Sept. 2015 Father came back  in March 2016 on another motion and I cross moved again for a change of venue, denied, judge saying(again) it is without prejudice and  among other things I should have moved for reconsideration in Sept or appealed, How final is Sept 2015 order and recent(April 2016) order ?

Assuming there were no further issues pending before the court upon the entry of both orders, they each are final.
