  • 1.  Final Restraining Order Hearing

    Hello Friends!

    I needed some advice. I have done FRO hearings, but they have always been Plaintiff based representations. This time I am representing the Defendant, husband, in an FRO hearing on Thursday, and he is in some serious issues. Naturally he claims she's lying, but does have some evidence to back him up. 

    I have an idea of how I would like to handle this, but being new at this, I would like to seek your advice on any anything I should be keeping in mind to discuss, stay away from, anything at all. I also had a few questions on the presentation of evidence.

    <x-tab>        </x-tab>Can you be a little more specific as to what you're asking?
    <x-tab>        </x-tab>The burden is on the plaintiff - if it's equal credibility, defendant should prevail.
    <x-tab>        </x-tab>What ulterior motives might there be to file the complaint? Custody, parenting time, support issues being discussed? Read Cesare, especially the "gate keeper" section.
    <x-tab>        </x-tab>Prep with him. Demeanor is everything. What's said is often less important than how it's said.

    <x-tab>        </x-tab>And remember Sun Tzu's advice in the Art of War ...the best way to win is not to fight. If she's represented, is a dismissal with civil restraints possible?
