  • 1.  FD filing fee madness

    Dear listmates: please help! I'm involved in an FD matter that is set down for a plenary hearing. Discovery was to be exchanged by Tuesday and the defendant failed to do so, so I file a motion to compel discovery on Wednesday. The notice to the bar we all received states that there is no filing fee for FD motions, $25 for other than initial complaints and applications for mods. Was just called by AC court and told I have to attach my motion to an application for mod and Pay a $25 fee. I told the clerk I am not seeking to MODIFY anything. This is just ridiculous. I double checked the filing fee on this and even referenced it in my cover letter, now I must draft an application to modify simply because that's what they are demanding must accompany my motion. Can someone please talk me down off this ledge?? Or explain to me how a motion to compel requires any fee whatsoever? Thanks in advance. Counting down to Key West...     The FD forms mandated by the all-powerful and controlling AOC create two categories of "applications" for FD matters ("motions" no longer being part of the FD "system):" complaints and applications to modify.
