    two returned today in Ocean due to not completing the pro se form. I thought we were not required to do so per the  App court. Office called family division manger and was told above.

    You do not have to complete the pro se form, I though there was a judicial
    directive or notice to the bar confirming that, but I can't find it.

    Camden County apparently hasn't noticed their clerks either. I keep getting pro se "packets" in the mail when they return my FD motions. Isn't it unconstitutional to treat unmarried people with children differently than married people? Some of the judges won't even permit discovery in FD matters.

    Amended Rules (from the Omnibus Rules Amendment):

    Rule 5:4-2(i) - "Complaint in Non-Dissolution Matters. Non-dissolution
    actions shall commence with the filing of a verified complaint/counterclaim
    form promulgated by the Administrative Director of the Courts, *except that
    attorneys may file a non-conforming complaint*, which must have appended to
    it a completed supplement promulgated by the Administrative Director of the
    Courts. ..."

    The new rules also seem to allow FD cases more leniency in terms of
    granting discovery (although they are still deemed to be a summary support
    matter, they are now able to be placed on a complex track. (R. 5:4-2(j) and
    5:5-7(c))

    Ocean does not do it because they are awaiting action from the
    administrative office of the court to implement the Appellate Division
    Opinion.

    I think to be safe you submit the court form and then attach your own
    pleadings. That has worked for me.

    I filed one in Morris County, and before the clerk would accept it, the client had to come down and complete the pro se form.

    New Court Rule 5:4-2(i) provides that attorneys may submit their own "non-conforming" complaints/counterclaims in non-dissolution actions as long as they have appended an AOC-promulgated complaint/counterclaim.  I do not believe that there is a corresponding court rule regarding the filing of post-applications in non-dissolution matters, which appears to be governed by AOC Directive 08-11 issued 9/2/11 (Notices to the Bar  published 9/9/11).  See http://www.judiciary.state.nj.us/notices/2011/n110909c.pdf
