  • 1.  Family Part Filings

    Is there any guidance on Family Part filings during this crisis?

     

    I reviewed the notice setting up an email box for the filing of emergent applications and the notices relaxing the requirement that counsel send courtesy copies of digitally filed papers to Judges' Chambers.  These provisions appear aimed (at least in part) at preventing the submission of hard copies of documents.  However, I have not seen any notices about filing other documents (e.g. Answer, Motion, Case Information Statement, etc.) during this time.  

     

    Has anyone filed hard copies of documents during these last few weeks?  Are hard copies being accepted or is there some alternate method I am missing?  Thanks in advance!

    I also saw something about original signatures being waved, does that apply to family pleadings, also? It was not clear.

    We are mailing anything "non-emergent" to the court as well as providing same to our adversaries.

    We believe that original signature requirement has been waived with the 3/27 order at page 13.

    It is likely best to check with the county that you are dealing with. It seems that each county is setting up their own systems.

    Emergent filings can be e-mailed in or dropped off at a dropbox outside of the courthouse.  Here is a link to the information about emergent filings which includes the e-mail addresses for each county:


    It is my understanding that each county will also be establishing e-mail addresses for regular (non-emergent) filings.  Until those e-mails are established, I believe you must file your family part documents by mail (or hand-delivery to the drop box outside of the courthouse).

    all non-emergent matters should be mailed to the courthouse.  the various courthouses have a procedure in place to sterilize the mail for a period of time before it is delivered to the judges etc.
