The Child Support Guidelines: How to Advocate to Deviate will both be held at the New Jersey Law Center.
On Monday, Nov. 11, NJICLE and the section will present Hot Tips in Family Law: "Rules are made to be broken: exceptions, dissents and loopholes." While all Family Part matters have common characteristics, every divorce, custody case, division of property or support action are unique because a family is involved. What is suitable practice in the majority of cases may be completely wrong for others, and exceptional cases may often require unique solutions. Recognizing your case's uniqueness and knowing when
to step out of bounds are key elements in successful matrimonial litigation.
Some rules are simply made to be broken, and knowing when and how to break them is the mark of a seasoned and thoughtful family law practitioner.
This year's fast-paced Hot Tips in Family Law highlights unique situations when you should consider stepping "out of bounds". Our panelists are skilled family law practitioners who will share their considerable experience about when to break rules and step outside the perimeter of routine practice in pursuit of the right result for your client.

Children are entitled to support by their parents, whether the parents are married or not. Like many states, New Jersey uses guidelines that consider family size, income levels and custodial status of the parents for determining support awards. But the guidelines are just that, guidelines, and many circumstances, such as the disability of a parent or a child or long term unemployment justify deviating from the guidelines. Astute family lawyers know how to advocate aggressively for a digression when they believe such a petition has merit.
Guideline revisions were announced this fall. The changes include a lowering of some guideline amounts. Our informative seminar reviews the status of the anticipated changes, examines the methodology used in establishing the guidelines and takes a hard look at how to advocate for a deviation from the guidelines.
