Folks,
Hope you all can help me with a sanity check. This, of course, different from the "sanity clause." (Couldn't resist.)
In an FD or FM matter, is there any authority for a judge to say "even though payor is unemployed, we know payor's family has assets and therefor payor can use family assets as his get-out-of-jail card." Judge also doesn't think either Directive AOC 15-08 or Pasqua exist.
I always thought the answer to this question was a resounding "no." Without going into any details, however, I can say that not everyone agrees.
Thoughts?
Best,
Ed
