  • 1.  Fairfax, Va Family Attorney

    All, 
    I'm looking for a recommendation for a family attorney in the Langley, Virginia area.  Parties are married with very young children and have been in Va for a couple of years due to Husband being in the Air Force.  A divorce action is imminent, and both plan on leaving the area in the coming months - Husband to Alabama and Wife to New Jersey, believe it or not.   For obvious reasons, the custody aspect could become complicated. 
    Any names would help.

    If the children are young, they will undoubtedly need to go back for modifications at some point.  If they are both planning to leave the jurisdiction, they are better off going through the divorce in the state where the parent of primary residence plans to settle, so that any court order governing the children is in the same place where they live. Otherwise they are going to have to transfer the order, etc, etc.  I would suggest they do a mutual interim order right now, under a non-dissolution action, covering visitation and CS in the court in VA, and then do the divorce in NJ (as I am guessing Mom will have primary, at least in the immediacy).
