  • 1.  Explanation of use of CS funds

    Is there a case that precludes the payor of child support from requiring the recipient to provide an accounting of the child support monies?  I thought there was, but I have been having difficulty finding one.  I know (some of) the arguments are that it would be unduly burdensome on the recipient and the Court presumes both parents act in the child's best interests, but I'd like more to back up my argument.

    Greg Check the comments to the CSG's. You may cone across some decent language there. The concept is oretty old. The courts would be asked to micromanage. They don't like that idea. If Payor could prove serious waste, such as child support beibg used for a drug or gambling habit, then Payor would have a decent shot.     Just go to the Child support guidelines - it's clear that the custodial parent can use child support for all household expenses, including mortgage and car payments. there is no requirement that the money MUST be used to purchase items for the child.
