    What rules does this forum have (if any) on an attorney's proper use of Q&A threads initiated by their adversary?

    If no viable rules exist, how does everyone balance these risks against the benefits of using the forum?

    What specific concerns do you have?  What specific risks do you see being taken?

    It is a general question but here's why...

    Posters generally provide factual information about their case in order to solicit ideas and feedback from the forum.  Often the poster is looking for help on overcoming some legal challenge they might be facing.  Since their adversary is also reading the posts and responses, s/he is now informed about what strategy their opponent may be formulating.  So my question basically revolves around the old adage of "forewarned is forearmed."  In other words, how can the benefits of the forum be balanced against the risk of providing your adversary with a tactical advantage?

    You might consider framing your questions as hypotheticals with facts irrelevant to the issues significantly altered.

    Those who post do so at their own risk.  That has been stated many times in the past two years.  Although it may not be true that adversary counsel is always reading what you ask about and the answers that are given, it pays to presume that s/he is, and to tailor the inquiries accordingly, or ask folks from the list offline for their opinions.

    It is an important point, worth bringing up periodically, IMO.

    Good point about offline opinions. But it defeats the communal benefits of the forum and can generate duplicate responses for the poster. It also degrades the quality of the feedback because it doesn't permit people to piggyback off each others' answers.

    Guess it's a Catch-22 scenario we have to live with.
