  • 1.  Enforcing parenting time for unmarried couple

    Am I correct in assuming that, for an unmarried couple, with a father who suddenly is being denied parenting time by the child's mother (because she has a new boyfriend), proper procedure is to file a form Verified Complaint with an FD docket #? 
    There was a previous FD case involving the establishing paternity itself, but I assume we should not be seeking to reinstate this complaint?

    I believe you would always use the same FD docket number, but otherwise you are correct.

    Depending upon the county, you would file a new FD complaint, but it will likely result in the same caption and docket number as the paternity action.
