  • 1.  Enforcement Of NJ Arrest Warrant In Another State

    I represent a woman whose ex stopped paying court-ordered alimony and moved to another state. I filed for enforcement. After two tries, I obtained an Order out of Burlington County for an immediate arrest warrant.

    The Probation Dept doesn't seem to want to do anything to enforce this warrant. Local law enforcement authorities in the other state won't arrest the guy without the warrant being entered a national database of warrants, and the Probation Dept won't enter it.

    The ex is still paying nothing.

    I'm stuck.

    Any suggestions?

    Ask the court for an order compelling Probation to enter the warrant into the database.

    <x-tab>        </x-tab>Yeah, LOL... suspend his driver's license. That's one of the few times it's legitimate and effective. Probation can suspend it reciprocally in whatever state he's living in. More on the topic: www.dpdlaw.com/kavadas
    <x-tab>        </x-tab>Also make sure tax intercept is in place - probation has to refer it for the collection program (not automatic when it's spousal support, not child support, at issue).
