Techno-Ethics and the three "C"s of the RPCs: How Use of Technology in Your Practice implicates RPCs of Competence (NJ RPC 1.1), Communication (NJ RPC 1.4) and Confidentiality (NJ RPC 1.6)
Practicing law in today's technology-infused society, this presentation will reaffirm how we as attorneys can embrace the opportunities afforded by technology to serve our clients better but cannot afford to ignore the risks posed.
We will discuss the presence of metadata in electronic documents and how to address same, including whether or not metadata should be minimized ("scrubbed" or "stripped") in the documents you distribute, and if you can or should seek to access and review metadata in documents received ("mined") by the use of software tools.
We will next consider lawyering on the go, enabled by mobile devices with cautions about geotagging and locational data disclosure issues.
Finally, we will review the ABA Formal Ethics Opinion issued earlier this year on "Securing Communication of Protected Client Information" outlining advice on Ethical Imperatives of Cyber Security.
