Does remarriage automatically vacate all provisions of a JOD?

  • 1.  Does remarriage automatically vacate all provisions of a JOD?

    Parties divorced in 2008.
    Remarried in 2009.
    Parties separated in June of this year.
    Complaint filed November 2015.
    Wife doesn't work - minimal, minimum wage jobs.
    Husband is a cop - retired 9/1/2013 and immediately began working, so in addition to pension, earns about $60,000. He's 52.

    JOD called for permanent alimony. I think that the remarriage automatically terminated that.
    JOD also called for a QDRO of Husband's pension. Wife never had one drafted.

    1. Anyone know of a case as to whether the remarriage vacated the QDRO provision?
    2. Any argument that this is this is now a six year marriage now for alimony purposes?
    3. Any case that would address when lifestyle would be calculated?
