I have a matter where fourteen months after the filing of a complaint, as the case was nearing trial, one of the parties fell and injured his back and has been out of work. It's been a developing situation as far as being declared disabled, getting experts as to his current ability to work, etc. Through no one's fault, the case isn't ready for trial but is now over 2 years old. The judge has agreed under these unusual circumstances to the dismissal and refilling of the complaint. I'm not sure exactly what a consent order for this would say. Any comments on the below (or anyone who has had experience with doing a consent order like this)?
1. The complaint in this matter is dismissed without prejudice.
2. All existing orders shall be transferred to the new docket number upon the refilling of the complaint, and all orders remain in effect without modification.
Any problems with the above or anything else that might be added?
