Hello listmates,
Client's husband became disabled from his job approximately 10 months ago and he just received $24,400 as a lump sum payment in "disability pension payments" for that time period. Six months of the disability was during the marriage. Husband just retired and I am assuming that is why he received the payment.
Q - Is the wife entitled to any of the monies as a form of equitable distribution? I am not sure what the money actually represents or how they were categorized by the union. Cases or any assistance would be truly appreciated.
