  • 1.  Determination of prenup validity

    The prenup statute says that the enforceability of a prenup should be resolved pretrial, via motion.

    Anyone know if this preclude a party from, instead of filing a motion, raising the issue at trial? In other words, if no application is made prior to trial, has the party waived the right to raise the issue?

    I would say yes.  It is a preliminary issue that would change the landscape of the divorce if it is uneforceable.  sometimes, it requires  a plenary hearing prior to the actual divorce trial.
