  • 1.  Counties / judge permitting no-appearence / "on the papers" divorces

    Posted 07-21-2018 06:37 PM
As most know, an AOC directive from several years ago permits courts to enter judgment on the papers without requiring a physical appearance. The judges and counties permitting attorneys to utilize this procedure changes over time. Here's a sample of the documents required: http://www.dpdlaw.com/NoAppearDocs.pdf

Can anyone add to / correct this list as to which counties / which judges are currently permitting it?

    Mercer - <x-tab>       </x-tab>permitted by all judges
    Somerset - <x-tab>     </x-tab>permitted by all judges
    Hunterdon - <x-tab>    </x-tab>permitted by all judges
Middlesex - <x-tab>    </x-tab>appears to be a judge-to-judge issue? Some are permitting it, some only if special permission (via a letter) is requested, some aren't permitting it
    Burlington - <x-tab>   </x-tab>No judges permit it

Let me clarify.  No divorces on the papers alone.  There are occasions when litigants participate by phone with arrangements having been made in advance.

Morris/Sussex are planning to allow them (per Judge Berdote-Byrne at the last Bench-Bar Conference) but have not yet gotten things up and running.
