    How about a link to where we might order a copy?

    I used to get one (unnamed) collection of cases and Family Law topics, and ordered the updates every year, until in a two month span I was informed by the court that I'd cited rules that no longer existed or were wrong, and cases that were no longer good law... all of which were (upon my checking) the situation when I received what was supposed to have been an up-to-date copy.  But I, for one, would take another look at a good resource.

    Not to digress on this thread, but when poking around on the Gann website, I saw the "Appellate Practice" book.  Any fellow appellate practitioners ordered this?  What does it have over and above the NJ Court Rules?  Anyone ordered it who has an opinion on whether it's worth the cost?  Thanks.

    I use the Appellate Practice Gann text regularly. It is the single best volume available on point, IMO.

    Like all Gann books, the one on Appellate Practice dissects the key topics and breaks them down manageably. There are sections on Appealability, Appellate Division, Supreme Court, Appellate Procedure, Scope and Standards of Review, and appendices on a variety of subjects, including Notices to the Bar and sample pleadings.



    I do not find the Court Rules on appellate practice to be particularly easy to read, so for me a volume like this is helpful.

    I agree.  I love Gann Appellate Practice!  I recently had an appellate brief on a really arcane appellate procedural question and it gave me the foundation cases for my argument.  You are right, Pressler Verniero is very useful, but for the appellate work Gann Appellate is better.

    I also like Gann NJ Rules of Evidence.  Pressler Verniero doesn't include evidence; West includes evidence but is not annotated.  The Gann has been helpful for me on both the trial and appellate levels.

    Well, I'll also give an enthusiastic plug for the Appellate Practice Gann book.  Wow.  I took it home and ended up reading whole sections over the weekend.  I've done a fair amount of Appellate Division work and cannot believe I didn't get this earlier.  Just "wow" - it would have saved hours and hours of work, and is meticulously organized and easy to read.  I highly, highly recommend it for anyone who does appeals.  Outstanding!  Mandatory tool for appellate practitioners.

    I just did in an appellate brief.  I was making a motion for summary disposition of an abuse/neglect finding in light of DCPP vs. Y.N.  The book said a motion for summary disposition is the appellate equivalent of a motion for summary judgment, which was exactly my point.  In my case, the facts were not in dispute and the result was controlled by Y.N.  The book did not cite any authority for its statement, so I just cited the book because I think it is self-evident.  By the way, the author is Jeffrey Mandell, who is a member of the NJSBA Appellate Practice Committee, of which I am a member.  I cited it in the same way I would cite a treatise.

    I'd asked earlier about whether it was proper to cite to the NJ Appellate Practice Gann book to the Court.  I ran across this today while continuing research on the NJ Civil Rights Act, thought it might be helpful.  It cites a commentary and has a format for citing (but wouldn't we also want to include a page number reference?):


    State v. O'Neil, 219 N.J. 598, 601 (2014)  : It also bears mentioning that a widely read commentator, in discussing N.J.S.A. 2C:3-9 at the time of defendant's direct appeal, warned that "[Moore] should not be read to indicate that the subsection means that the justification of self-defense is unavailable against any charge based on recklessness." Cannel, New Jersey Criminal Code Annotated, comment 4 on N.J.S.A. 2C:3-9 (2002). The commentator emphasized that "[i]f the actor is justified in using the actual force that occurred, the justification is available against all charges 824*824 based on the force." Ibid. That commentary foreshadowed the Appellate Division decision in Rodriguez.

    Just double-checked the style manual on that question to make sure I was right.  Yes, that citation is correct per the style manual, p. 15.  You don't need a page number reference.  I normally just defer to the style manual.  It has some variations from blue book, but I just give them what they want.
