  • 1.  Civil Restraints among unmarried parties when dismissing TRO

    I represent a woman involved in a DV action with ex boyfriend (they have 2 children together) and each party has TRO against the other. Both parties will dismiss and enter civil restraints against each other and agree upon  child support and custody. Since the parties were not married and no divorce action, dont they have to file a child support action in order to file the Consent Order?

    Yes.  Those actions are so easy to file.  You could open up an FM case at the court house, then walk down the hallway for a mutual dismissal of the DV's, conditioned upon simultaneous entry of a consent order, which the DV Judge will do.

    Check with the Family Division Office.  They may be able to assign a FD docket number to the child support and/or parenting time issues without any fanfare.
