  • 1.  citizenship status as consideration

    Client brought spouse to the U.S. from Turkey.  They married and she became a citizen.  She sought divorce a year after gaining citizenship.  Marriage lasted 5 years.  One child.  Is there case law where citizenship is counted as an asset for purposes of ED?

    No.  It has no indicia of property.  It is personal to the holder and can't be transferred.

    The NJ Supreme Court many years ago discarded the argument that professional licensure is an asset.  The same would almost certainly be true for citizenship, which is a status, not an asset.
