  • 1.  CHILD SUPPORT PAYABLE TO GUARDIAN

    Posted 04-30-2012 03:17 PM
    Greetings,

I represent the Father of a 15 year old boy.  The Mother is disabled.  Neither parent has custody of the child.  The child is in the custody of guardians.  The Guardian ad litem for the child has initiated a child support action to establish child support in favor of the guardians of the child.  Since neither parent is in custody of the child, how does the child support obligation get apportioned between the parents?

    Thank you for your help.

The situation (child in custody of third party) is specifically addressed in Appendix IX-A (See section 16., page 21 of the PDF):   http://www.judiciary.state.nj.us/csguide/app9a.pdf
