  • 1.  Child Support Enforcement- Non-reciprocity between Peru and U.S.?

    It doesnt appear that Peru has reciprocity with US for enforcement of child support. What arguments can be made to enforce Peruvian order here in NJ for many years of unpaid support by lifelong NJ resident Dad? (both parents now live in NJ.. Thanks

    Christine:  A listing of the countries with which NJ has reciprocity for child support purposes is available on the federal Office of Child Support Enforcement Intergovernmental Reference Guide website at https://ocsp.acf.hhs.gov/irg/welcome.html  Go to NJ and then to Reciprocity.  (The IRG is a very useful resource for information about the child support laws of other jurisdcitions.)  Although Peru is not on the list, you may have a shot filing to give full faith and credit to the Peruvian order and to modify the obligation.  However, an argument can be made, as per UIFSA, that support emanicaption would occur as per Peruvian law, which may or may not work to your client's advantage..
