  • 1.  Child attending in either parent's school district without tuition - reg or NJSA cite?

    Posted 01-13-2018 10:02 PM
I know this came up a while ago, but I'm not sure if it was on this list.

Child, 17, has moved from one parent's house to the other and we're consenting to a change in custody. The child is a senior and wants to finish school in the other parent's district.

I am almost positive there is a statute or administrative regulation that permits this - that says that a child can attend in either parent's district without tuition if there is a court order instructing it.

If anyone knows what said statute is, please advise. It's a new judge and I'd obviously like to quote it to her.

    Thanks,

    David Perry Davis, Esq.

It is the Administrative Code (6A:22-3.1) implementing NJSA 18A:38-1.
    Good luck.
