Mother can file. Child support is not for the parties to waive. Judges may find such agreements, even with underlying consideration, to be unenforceable. Start with Ordukaya v. Brown.

I have a client/mother who waived direct child support for 19 yr old child residing at college due to uneven distribution of assets. However now mother is having trouble meeting all of extra expenses for child for dental, car expenses and other expenses. Does anyone know if child file her own FD complaint for direct child support from father? Thanks.
