  • 1.  Bankruptcy and equitable distribution

    In order to finalize equitable distribution, client would need to bring $47,000 to the closing on the former marital residence.  He doesn't have it except by invading a retirement account.

    The funds owed to the ex are not child support, alimony, nor counsel fees used to secure them.  Would bankruptcy potentially help?  I know they've tightened up what constitutes a non-dischargeable "domestic support obligation", but I'm not clear whether there's still an ability to discharge equitable distribution.

    Anyone know?  And/or know someone who dual specializes in Family and bankruptcy and could review the options with the client?

    Hi. It's Brian Winters. The answer is that it depends upon chapter 7 vs 13. In a 13, but not a 7, a debtor may discharge equitable distribution.

    I have the circumstance pending now. I represent the chapter 13 debtor and we are discharging e.d , right along with taxes and some dui surcharges


    I'd like to see the psa, but , yeah, that's the deal.
