    On Monday, Dec. 9, NJICLE will present Asset Protection Planning in 2020: An Essential Crash Course from 9 a.m. to 1 p.m. at the New Jersey Law Center.

    Why You Need to Attend:
    Clients often ask how to protect themselves and their assets from the reach of creditors. Accordingly, asset protection planning involves ways to legally structure one's asset holdings so as to protect assets from the claims of creditors. A variety of techniques can be used to deter creditors - and to allow your clients to hold on to assets.

    About the Program:
    Professionals including doctors, lawyers and accountants all seek ways to protect their personal assets from the claims of potential creditors. Business clients also look for ways to protect their assets from creditors, including the IRS, or when they enter into financing and business arrangements. Likewise, parents are concerned with leaving assets to children who have their own creditor concerns including ex-spouses. At this program, you will learn a variety of rock-solid techniques to shield assets from creditors.

    Domestic Asset Protection Trusts
    Approximately 25% of the 50 states have enacted legislation providing for self-settled asset protection trusts. New Jersey has not yet adopted such legislation. This seminar will make you aware of this growing trend, and whether you should consider recommending an asset protection trust to your clients.
    Fraudulent Conveyances
    Learn the "dos and dont's" of transferring assets in order to protect the assets from the claims of creditors.
    Reexamining Trusts in Which the Grantor is Not a Beneficiary
    Asset protection planning is also relevant where a grantor establishes a trust for the benefit of family members and other third parties. What measures should be considered to insulate trust assets from the claims of the beneficiary’s creditors and how does the recently enacted Uniform Trust Act impact creditors?
    Limited Liability Companies and Other Asset Planning Techniques
    Find out the latest on how interests in limited liability companies and other asset protection techniques are being treated by the bankruptcy courts. We will also discuss how assets should be titled for married couples including the benefits provided by holding property as tenants. Also we will discuss qualified retirement plans.
    State Income Tax Savings
    Discover how domestic asset protection trusts can be used to entirely avoid recognizing income for the New Jersey state income tax purposes.

    CLE Credits:
    NJ CLE information: This program has been approved by the Board on Continuing Legal Education of the Supreme Court of New Jersey for 4.5 hours of total CLE credit. Of these,1.2 qualify as hours of credit for ethics/professionalism.
    NJ CLE: This program has been approved for 4.5 credits (50 minute hour), including 1.2 ethics/professionalism
    PA CLE: 2.5 substantive and 1.0 ethics credits pending ($16 fee – separate check payable to NJICLE must be submitted at the end of the program)
    NY CLE (nt): 3.5 professional practice and 1.0 ethics credits
    CPE: 3.5 taxation and 1.0 professional ethics credits

    The tuition for NJSBA members is $160. The general tuition is $200. Tuition onsite is $240.
