  • 1.  Arranged marriage in India/divorce

    Dear Listmates,

    I have a client who was married in India within the last year based upon an arranged marriage.  He has found out that his "wife" was only using him to come to the US and bring her extended family with her in addition to trying to extort money from my client who was raised here in the US.  He now wishes to get a divorce but has concerns regarding Indian law and he has just received a notice that he is to appear in India within the next 15 days because he is being accused by his wife of marital rape.

    Is there any one on this list who is familiar with Indian law and if there is anything that I should be concerned with?  Is anyone an attorney in India who I can have my client contact regarding this matter?

    First: don't let him go to India.  I would imagine they might now pull to the other extreme because of all the bad press re: recent gang rapes in the country and the failure to prosecute until very recently.

    Also, is he a US citizen or green card.  If not a US citizen, he may not want to step foot out of this country because the rape charge will keep him out.  Along with the attorney suggestion from a previous responder, you should consult with an Immigration Attorney.
