  • 1.  Any filing fee for a post-judgment consent order?

    Is there a filing fee for a post-divorce judgment consent order?

     

    Is there any filing fee for an FD consent order? Or for a FO motion?

     

    I filed a motion in a contempt case with a FO docket number to have the complaint dismissed as being de minimis. Any filing fee?

    The typical law answer is "It depends."

    Post- Jmt consent order....

    If it's Gloucester County and it's a post-judgment consent order for anything but consenting to go to mediation, then no. If it's a post-judgment consent order for mediation then yes, you have to file a Notice of Motion for mediation and attach your consent order, with that $50 check. Camden, Cumberland, Salem, Atlantic, Cape May, Burlington, no. If it's anywhere else, "it depends"

    FD Consent Order

    If it's Gloucester County and it's a consent order for anything but consenting to go to mediation, then no. If it's a FD consent order for mediation then yes, you have to file a FD generic Application for mediation and attach your consent order, with that $25 check. Camden, Cumberland, Salem, Atlantic, Cape May, Burlington, no. If it's anywhere else, "it depends"

    FO Motion

    My understanding is it's $50 filing fee.

    I become more enraged with the disparity of fees across counties each day...

    Just had a check returned to me that I sent in with a Record Request. The check was returned because it was "too much" and a letter enclosed asked that I send back a check for $0.50 (yes, fifty cents).... mind you this request was sent in an envelope with $0.485 postage.

    I apologize, I hit send too soon, without reading the entirety of your
    email. For a post-judgment Consent Order, there is no filing fee in
    Hunterdon, Warren or Somerset counties and many others, I am sure, but I
    will defer to Ms. Lis's much more thoughtful response for the other answers.

    Liz -

    Where is the authority in the fee schedule for a court to charge for the filing of a consent order in any matter??

    And Bob - post-judgment FD is $25, no fee for FV / FO. At least none in the schedule. 

    When they approved these fee hikes, they were supposed to streamline the waiver process and make it clear that fee waivers are available.  Lots of signs up at every courthouse I've seen about the new fees. Nothing I've seen about a better system for waiver (or even published standards for them). It's AS IF our AOC isn't overly concerned with access to the justice system by the poor.
