  • 1.  Amending QDRO post divorce

    Both parties, in their late 60s,  have agreed post divorce (parties divorced April 2016) to change the date of the beginning of payout of wife's pension distributions.  Divorce judgement states date of retirement as beginning of payout, which retirement date is still unknown. Wife would now like it to begin as of either date of  divorce or now.  I assume that I will prepare Consent Order to Amend QDRO and then prepare new QDRO?

    Make sure the plan allows payout to wife of her share before husband retires and begin collecting.  If so, then your suggestion is correct:  consent order permitting the modification of the original QDRO, preparation of Amended QDRO and then submit to Plan Administrator.  Can probably save a step and attach the Amended QDRO to the C.O.  and have judge sign both.  Make sure you request (AND PAY FOR) a Certified copy of the Amended QDRO for Administrator.
