  • 1.  Alimony Question

    Posted 08-29-2022 01:13 PM
    Hello.
I remember there being a case that discussed if a spouse is entitled to base the alimony award on the amount the payor spouse earned at the end of the marriage if there was a big increase from the year before.
    Does anyone remember this case?
    Thank you for your help.

    Hi Debra,

Take a look at  "momentum of the marriage." See Dudas v. Dudas, 423 N.J. Super. 69 (Ch. Div. 2011).

Alimony is based on life style during overture.
Child support is based on present earnings and need.
