  • 1.  Adoption of Child by same-sex couple

    Check out the published trial court decision, Adoption of Child by GAS and MAS, brought before the court by Debra Guston.  Citing the Legal Parentage Act, the judge confirmed that the petitioning same-sex couple was able to use the "streamlined" adoption process which dispenses with the need for a home study and background checks.  
    Judge Mendez (whose retirement celebration occurs tomorrow) authored the well-written opinion. He goes out with a bang.

    Judge Mendez called me a few days ago to tell me this had been approved for publishing. It was a surprise that he wrote this opinion, but I welcomed it as confirmation that the judiciary understood the process and need for the new confirmatory adoption statute on which Bill Singer and I worked to get passed in 2019-20.
