    Hello Family Law Section members,

    On Saturday, April 13, NJICLE will present the AAML Annual Conference - Taxes and Divorce in 2019 and Beyond from 9 a.m. to 12:35 p.m. at the New Jersey Law Center.

    American tax payers lost 11 deductions this year. How will those changes affect your matrimonial clients?
    The Tax Cut and Jobs Act (TCJA) has ushered in a whole new era in matrimonial law. For couples divorcing in 2019 and beyond, the Act's modification and virtual elimination of many deductions will have a significant impact on your divorcing clients. Americans can no longer deduct for alimony, for an unlimited amount of interest on home equity loans, certain donations to schools, moving expenses, more than $10,000 spent on state and local taxes, and more. The elimination of the alimony deduction de facto eliminates the shifting of tax brackets between the parties.

    How can you protect your clients from the absence of these long-depended upon deductions?
    Join us at the AAML-NJ Annual Conference as we bring together top practitioners, judges and other professionals in the family law community for a day of legal education. This year, the conference will focus on the TCJA and examine how it impacts the financial aspects of divorce. Experts will provide guidance about the most important issues to keep in mind and how to best approach negotiations and settlements in 2019 and beyond. Our speakers will highlight and decipher prevalent sections of the tax code and regulations, review current case law and provide you with up to the minute tips and strategies that you can immediately put to use in your practice.     • Modification of pre-2019 agreements
    • Alimony alternatives and the transfer or assignment of retirement funds or other personal or business assets in lieu of alimony
    • Considerations regarding child tax credits and phase-out's, 529 Plans, education credits and kiddie tax
    • $10,000 SALT (State and Local Tax Deductions) limitation and mortgage interest deduction limitation - are there work-arounds that will counteract the effects?

    • Should agreements negotiated after the beginning of 2019 include provisions that address the future possibility of repeal or changes to TCJA? If so, what is the most effective language to use in those agreements?

    CLE Credits:
    NJ CLE information: This program has been approved by the Board on Continuing Legal Education of the Supreme Court of New Jersey for 4.0 hours of total CLE credit. Of these, 4.0 qualify as hours of credit toward certification in matrimonial law.
    NJ CLE: This program has been approved for 4.0 credits (50 minute hour)
    Matrimonial Law Certification: 4.0 general credits pending
    CPE: 4.0 taxation credits (Please note: CPE credits are not available for the webcast.)
    PA CLE: 3.0 substantive credits pending ($12 fee – separate check payable to NJICLE must be submitted at the end of the program)
    NY CLE (nt): 4.0 professional practice credits

    The tuition for NJSBA members is $160. The general tuition is $200. Tuition onsite is $240.
