Greetings everyone - hope you're all well. A few of my collegues and I will be in Washington this Friday, March 15, 2019, to hear oral argument on
United Keetoowah Band of Chero v. FCC (case number 18-1129).
The Natural Resources Defense Council (
NRDC) is challenging the FCC's authority to accelerate the deployment of 5G. The brief presents the Court with three issues: (1) whether the FCC failed to complete the environmental analysis required by the
National Environmental Policy Act (
NEPA) before issuing its Order (
FCC 18-30); (2) whether the FCC can lawfully avoid NEPA analysis for the use of a new electromagnetic spectrum that it has licensed; and (3) whether the FCC's determination that it has met the public interest standard of the
Communications Act is arbitrary and capricious. The decision in this case might help stop the FCC from excluding the voice of the public and undermining the democratic decision making process. If you want to understand just how nefarious the FCC can be, consider reading "
