    Hello Family Law Section members,

    On Wednesday, April 5, NJICLE in cooperation with the NJSBA Administrative Law Section and Senior Lawyers Committee are presenting the 2017 Administrative Law Forum: Hot Topics for Litigators and Administrative Law Practitioners from 9 a.m. to 3 p.m. at the New Jersey Law Center.

    This annual gathering of Administrative Law Judges and some of New Jersey’s top practitioners will address a wide range of issues that you’re likely to face when presenting matters before the Office of Administrative Law (OAL).

    New Jersey Supreme Court Justice Jayne LaVecchia, former Director and Chief Administrative Law Judge for the Office of Administrative Law, will deliver the keynote presentation, followed by a presentation by Acting Director and Chief Administrative Law Judge, Hon. Laura Sanders on the Recent Developments at the OAL. The final segment of the program is an afternoon round table featuring administrative judges presenting some of the hot button issues for 2017.

    • Education Law:

    • Medicaid - Special Needs Trusts, Qualified Income Trusts and the Elderly (including Divorce) 
    Civil service - Choice of Forum, Application of Winters to current practice, including LAD and civil rights claims
    Meet the ALJs – Roundtable questions include:
         1. DYFS cases – How old does the child have to be for you to expect that he or she will be produced, or at least his or her absence explained?
         2. Hearsay – To object or not to object, that is the question when you know hearsay is
            admissible subject to the residuum rule.
         3. How do judges like for the attorneys to resolve discovery issues ?
         4. In what types of cases are their special rules governing the handling of the case? Why          do they need to know those rules in addition to the OAL rules?
         5. Motion practice – How can attorneys use the pre-hearing conference to flesh out                  whether filing a motion for summary decision will be useful?
         6. How can attorneys better communicate with each other to foster a more productive                pre-hearing conference and more efficient hearing?
         7. Why is it not a good idea for attorneys to file documents with the judge without the              judge asking for them?
         8. What is the role of the agency in interpreting statutes that impact it, i.e. Chevron?               Should the agency’s interpretation be given that deference that it has been given?
