Recent Ruling Likely to Have a Significant Effect on Internships in the Entertainment Industry

Earlier this month, the U.S. District Court for the Southern District of New York ruled that Fox Searchlight Pictures violated federal and New York minimum wage laws for failing to pay production interns working on the movie, “Black Swan.” In finding that the internships did not constitute an educational environment, Judge William H. Pauley III reasoned that Fox received an immediate advantage from the interns performing tasks that were typically handled by paid employees. The Court also indicated that unpaid internships should be permitted sparingly under certain circumstances.
