On the heels of a moratorium imposed by Gov. Mikie Sherrill on all pending regulations, the New Jersey Department of Labor and Workforce Development adopted new regulations addressing the ABC test for determining whether someone is an employee or an independent contractor. The New Jersey State Bar Association voiced strong opposition to the proposed rules by then-Gov. Phil Murphy and remains concerned about these new rules.
The NJDOL said the new rules take into consideration the extensive comments on the last administration’s proposed rules and “provide New Jersey businesses with clarity and guidance to be able to compete fairly and comply with the state’s labor laws by classifying workers correctly.”
The NJSBA voiced concerns about the impact of the prior proposed rules by the Murphy Administration on law firms, especially solo and small law firms that rely on per diem work to accommodate work flows. “The impact of these Proposed Rules may not only be felt by all attorneys, but also by the professionals regularly engaged by attorneys in the practice of law,” NJSBA President Christine A. Amalfe said in comments submitted to the NJDOL last year.

The Senate Labor Committee has scheduled a hearing on the new test for May 11 at 10:30 a.m. The NJSBA is closely monitoring the issue.
