  • 1.  Enforcement of Fee Arbitration Determination

    I have recently received a favorable determination from the Fee Arbitration Committee.  I am seeking to enforce same.  Pursuant to Rule 1:20A-3, I may file a summary action pursuant to R. 4:67 to obtain judgment in the amount of the fee.  Please note this is from a client who retained my firm for a post judgment family law matter (I note this because of 4:67b and am not clear if that is relevant). 

    Can someone please provide me with some guidance as to same.  If anyone is willing to share their forms, it would be greatly appreciated.

    In addition, can an attorney put forth a request for wage garnishment in the same action?

    file an OSC to enforce fee arb award pursuant to the Rule.  wage garnishment can only be filed after judgment is perfected.

    I have a client who has all but disappeared for several months. I need to WD from case and also file for arb award (retainer has clause for arb) and ultimately enforcement.
