  • 1.  Motion in Limine

    I have a procedural question.

    My adversary filed a Motion in Limine.  Am I permitted to file a Cross Motion seeking unrelated interim relief (regarding parenting time and the like), but not related to the trial or trial issues.  I.e. it would not be a Cross Motion in Limine.

    Ann,

    Is the Motion in Limine returnable on the first day of trial, or is it a regular motion return date?

    If it's the first trial day, then I would say no, don't do that.  File your own MIL if you want to.

    If you have regular motion issues, why not file your own motion, returnable on a regular motion day?

    The Motion in Limine is returnable the second day of trial actually.

    I didn't file as a regular motion because we're in the middle of trial and the relief can basically wait for the Judge's decision.  But since there is a pending motion, I wanted to see if I could take advantage.

    If you have a reason and basis to file for relief, then go ahead, irrespective of the MIL. If it's just to respond to a MIL, then don't. It's not that kind of a motion.
