The New Jersey State Bar Association is partnering with the New Jersey Judiciary on Sept. 17 for a half-day training session on the essential elements of Attorney-Conducted Voir Dire (ACVD). Attendees will learn about the new Supreme Court pilot program that allows ACVD in criminal matters starting in September in Bergen, Camden and Middlesex counties. The New Jersey Supreme Court decided whether the Tort Claims Act (TCA) applied against a public defender for legal malpractice case today, where a defendant was granted post-conviction relief dismissing an indictment against him and he was released from prison for a crime he did not commit. In Nieves v. Office of the Public Defender , the Court decided that the TCA applied to Antonio Chaparro Nieves’s legal malpractice action and his claims for loss of liberty damages failed to vault the verbal threshold for a pain and suffering damaged claim under the strictures of N.J.S.A. 59:9-2(d). As Trustee Liaison to the NJSBA Criminal Law Section, I want to congratulate our outgoing and incoming Chairs, Richard "Red" Barker and Alissa Hascup. Red Barker, our outgoing Chair and Deputy Public Defender in Charge of the Middlesex Region, has done great work, during his year as the Criminal Law Section Chair, in providing outstanding CLE programming at the NJSBA Criminal Law Section monthly meetings.
